Legal Analysis of Due Process Violations in Administrative Summaries within the Ministry of Education

Since the validity of the Constitution of the Republic of Ecuador in 2008, and subsequent promulgation of the Organic Law of Intercultural Education and its Regulations of 2010, the application of new disciplinary procedures specifically aimed at teachers begins; For these processes, compliance with routes and protocols is required that, according to education workers, leaves them in a state of defenselessness, which is evidenced by a high percentage of administrative summaries initiated that determine the guilt of the teacher. The legal analysis of violations of due process in administrative summaries within the Ministry of Education reveals the importance of safeguarding the fundamental rights of those involved in disciplinary processes. This review focuses on the protection of due process, ensuring that administrative procedures are fair, equitable, and respectful of individual rights. Possible violations of due process are identified when deficiencies are observed in limited access to relevant information, inadequate deadlines for preparing the defense, and lack of opportunities to present evidence and arguments. The analysis also highlights the importance of an impartial and motivated resolution by the administrative authorities. Violations of due process can have significant consequences, such as the annulment of administrative decisions or the invalidation of sanctions imposed, in addition to the harm to those sued. The need to establish clear procedures that guarantee compliance with legal standards to prevent irregularities in administrative summaries is highlighted. Ultimately, this analysis highlights the relevance of a balanced approach that allows for the effectiveness of administrative management without sacrificing the fundamental rights of individuals subject to disciplinary processes in the educational field.
